Terms of use

These terms apply to the BadgeReady app for iOS and Android. By installing or using the app you agree to them. If you do not agree, do not use the app.

1. Who we are

BadgeReady is published by NextGen Software Ltd, a company registered in England and Wales with company number 14613977, of 167 to 169 Great Portland Street, 5th Floor, London, W1W 5PF. Our website is nextgensoftware.co.uk. You can contact us at support@badgeready.co.uk. In these terms, we, us and our mean NextGen Software Ltd.

2. What BadgeReady is

BadgeReady is a revision app for people preparing for the written papers of the qualifications linked to a Security Industry Authority (SIA) licence in the United Kingdom. It contains revision chapters, a glossary, practice questions, mock papers and a guide to the licensing process. Vehicle Immobiliser licensing applies in Northern Ireland only, and the app says so wherever that qualification appears.

BadgeReady is not affiliated with or endorsed by the Security Industry Authority or any awarding organisation. Questions are original practice material written from published specifications. No awarding organisation exam material is used. The SIA and each awarding organisation own their own names and marks, and nothing in the app claims otherwise. Any fee you pay for a licence or an exam is paid to the SIA, an awarding organisation or a training provider, never to us.

3. No accounts

The app does not ask you to create an account, and we do not hold any account for you. Your progress, answers, exam date, bookmarks, highlights and notes are stored on your device and nowhere else. Purchases are linked to the Apple ID or Google account you use with the App Store or Google Play, and those stores are the only record of what you own.

If you delete the app, reset your progress in Settings or lose your device, the data on that device is gone. We cannot restore it, because we never had it.

4. Free and paid content

Some of the app is free for each certification: the licensing guide, the certification chooser, every revision chapter for the certification you choose, the glossary and search, a 12 question sample mock and 25 practice questions with explanations. The rest, including the full question bank, unlimited mock papers, bookmarks, highlights, notes, spaced reviews, the retake deck and weak spots, is unlocked by a one time purchase.

Two products are available in the app:

• This certification, £7.99: unlocks one qualification, the one named on the unlock screen when you buy. You can buy it again for a different qualification.
• Every certification, £24.99: unlocks every qualification in this edition of the app, including any added to this edition later.

Each product is a one time purchase. There is no recurring charge and nothing renews. Prices are in pounds sterling and include VAT. The price you pay is the price the App Store or Google Play shows at the moment you buy, which may be shown in your own currency if your store account is outside the United Kingdom. The unlock lasts for as long as this edition of the app is available in the stores.

5. How purchases work

Purchases are made only through the App Store or Google Play, using the payment method on your store account. There is no other way to buy, and we never see your card or bank details.

To confirm that a purchase is valid and to restore it on another device, the app uses RevenueCat, a purchase processing service. RevenueCat receives the store receipt for your purchase and an anonymous app user ID generated on your device. It does not receive your name, email address or payment details. The privacy policy in Settings describes this in full.

You can restore purchases at any time with the Restore purchases button on the unlock screen or in Settings, using the same Apple ID or Google account that made the purchase. Family Sharing is switched off for every BadgeReady product, so a purchase unlocks the app on the store account that bought it and on no other.

6. Immediate access and your right to cancel

What you buy is digital content that is supplied as soon as the store confirms your purchase. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you would normally have 14 days to cancel a purchase made at a distance, but that right is lost once digital content is supplied with your agreement. The unlock screen says so before you buy: One time purchase. By buying you agree to immediate access and waive the 14 day cancellation right for digital content.

Refund requests are handled by Apple or Google under their own refund policies, because they took your payment. Their policies apply on top of these terms. Nothing in this section affects your rights under the Consumer Rights Act 2015, including the right to a repair, a replacement or a price reduction where digital content is faulty.

7. Using the app

You may use the app for your own personal, non commercial revision. You may not copy, extract, scrape, sell, publish or redistribute the chapters, questions, explanations, glossary or any other content in the app, and you may not use it to build another product or service. You may not attempt to bypass the purchase mechanism, interfere with the app's operation or use the app in any way that breaks the law.

Any notes, highlights and bookmarks you create remain yours. They stay on your device.

8. Content accuracy

The app is revision material. It is not legal advice, careers advice or a statement of the law. Legislation, SIA licensing criteria, qualification specifications and fees change. We review the content against published sources before each release, but we cannot promise that everything in the app is complete, current or error free at the moment you read it. The licensing guide summarises the process as we understand it and links to GOV.UK for the current position. Check GOV.UK and your training provider before you spend money.

Exam results depend on you, your course and the awarding organisation, not on us. We do not promise that using the app will lead to any exam result or to the grant of a licence, and the readiness figures in the app are estimates drawn from your own answers, not predictions.

9. Intellectual property

The app, its design and all of its content are owned by NextGen Software Ltd or licensed to us. All rights are reserved except as set out in these terms. The app includes open source software and fonts used under their own licences, which are listed in Settings under Open source licences.

10. Availability, updates and editions

We may update the app and its content at any time. We may change or withdraw free features, correct content, add qualifications or remove a qualification that no longer leads to a licence. When SIA specifications change materially, we may release a new edition of the app as a separate set of products. If we do, what you have already bought keeps working in the edition you bought it for.

The app works offline. Buying and restoring need an internet connection, because the App Store or Google Play and RevenueCat have to be reached.

11. Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

Subject to that, we are not liable for any loss that was not a foreseeable result of our breaking these terms, for any business loss, or for any loss arising from an exam result or a licence decision. Our total liability to you in connection with the app is limited to the amount you paid for the app in the 12 months before the claim arose.

We are not responsible for the content of GOV.UK or any other website the app links to.

12. Ending your use

You can stop using the app at any time by deleting it. We may stop providing the app, or suspend your access to paid features, if you break these terms in a serious way. If we withdraw the app entirely, your rights in relation to anything you have already bought are not affected.

13. Changes to these terms

We may change these terms to reflect changes in the law, the requirements of the App Store or Google Play, or changes to the app. The current version is always available in the app under Settings, with its version and date at the top. Changes do not take away anything you have already paid for.

14. App store terms

If you downloaded the app from the App Store, Apple's standard licence terms for apps also apply. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not party to these terms, but may enforce them as a third party beneficiary. Any claim about the app, including product liability, a failure to conform to a legal requirement or a consumer protection claim, is our responsibility and not Apple's. If you downloaded the app from Google Play, Google's terms of service for Google Play also apply. Where those store terms give you greater rights than these terms, the store terms win.

15. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute about them. If you live in Scotland or Northern Ireland you can also bring proceedings in the courts of the part of the United Kingdom where you live, and you keep the protection of any mandatory consumer law that applies there.
